The Legislative Yuan amended the Article 14 under the Act of Gender Equality in Employment, adding three extra days of menstruation leave that will not be deducted from common sick leave.

On November 26, 2013, the draft amendment to the Article 14 under the Act of Gender Equality in Employment passed its third reading in Legislative Yuan. The new Article provides that “When female employees encounter job difficulty because of menstruation, they may request a menstruation leave for one day in one month. The absent day shall not be incorporated into the day for sickness leave, if it was not more than three days. The number of rest absent days for this leave shall be incorporated into the day for sickness leave.” Effective as of the announcement by the Office of the President, female employees will be entitled to request three days of menstruation leave annually, which shall not be included in the common sick leave, and do not have to present supporting document in order to protect the working right of female labors.

Currently, the female employees are also entitled to twelve days of menstrual leave but the days off are all incorporated into the day for sickness leave. Sick leave within thirty days shall be paid with half salary.

In the future, female employees will be given three days of menstrual leave in addition to the thirty days of common sick leave in one year. In other words, the maximum days of health-related leaves in one year will be 33 days. Half pay shall be given for the first thirty days of leave while the additional three days of leave is left unpaid. According to the draft amendment to the Enforcement Rules to Gender Equality in Employment announced by the Labor Commission, the current basis that empowers employers to demand employees for documents supporting menstruation leave will be deleted. Violation will give rise to ten thousand to one hundred thousand New Taiwan Dollars.
