Labor: The amendments to the Labor Standards Act of Taiwan decreasing the number of statutory working hours to 40 hours per week will become effective on January 1, 2016.

The Legislative Yuan has passed the amendment to Article 30 of the Labor Standards Act (“Act”) on May 15, 2015 and the new amendment will become effective on January 1, 2016. The main changes were made to Article 30 of the Act as below:

1. Currently, workers shall not have regular working time in excess of eight hours a day and 84 hours every two weeks. The new amendment decreases the number of statutory working hours to 40 hours every week. In other words, workers will be allowed to have two days off every week.

2. Employers will be required to keep the time cards of workers for 5 years in the new amendment while the current retention period is for 1 year only. The penalty for a violation will be increased to between NTD90,000 and NTD450,000.

3. Employers may allow workers whose family members need to be taken care of to adjust, in the range of one hour, the start and the end of work of a day without changing the number of regular working hours each day.
